Terms of Service
The following terms of service may not be all inclusive. If you have any questions, please send a secure request using our secure request form.
User Profile
User must certify they are 13 years of age or over. All those individuals under 13 years of age will need a full release form from their parents before using any of Surf Utopia's services. This is in compliance with the Childrens Online Privacy Protection Act of 2000 (COPPA).
User Conduct
Surf Utopia's services may only be used for lawful purposes. Any use of these services which violates any local, state, federal, or international laws which may apply to Surf Utopia, your local jurisdiction, or any jurisdiction that user or user's site may be subject to is strictly prohibited.
While using the service, user may not:
- Restrict or inhibit any other user from using and enjoying the Internet;
- Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation to any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, including without limitation to the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws;
- Post, publish, transmit, reproduce or distribute any information or software which contains a virus or other harmful component;
- Post, publish, transmit, reproduce, distribute or in any way exploit any information, software, or other material obtained through the service for commercial purposes (other than as expressly permitted by the provider of such information, software, or other material);
User Content - Restrictions
User may not host content which is or could be construed in any way to be unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation to any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, including without limitation to the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws.
Adult-oriented sites, designed for entertainment or commercial purposes, are not allowed on Surf Utopia servers. Forbidden sites include those that provide access to pornographic materials (images or multimedia), whether for free or for payment, regardless of whether adult verification is used or not.
Besides the obvious high-traffic issues of hosting adult sites, we believe adult content is not well-suited to shared hosting services.
Refunds
If the user is not completely satisfied with the service provided, the user may request a refund for services paid for but not rendered at any time. The user may request a refund using the secure request form.
If the user is not completely satisfied with the service provided, and the user would like a full refund, including payments for services already rendered, please contact us as soon as possible using the secure request form. We will work towards a mutually agreeable refund.
No refunds are available for domain registrations, secure certificates, or any other externally provided registration, certificate signing, or other service or product.
